IMPORTANT TERMS AND CONDITIONS
This ticket is a non-renewable, revocable license granted by Pittsburgh Associates, LP (“Pirates”) to allow the ticket holder (“Holder”) to enter the ballpark and surrounding areas, including parking lots (“Facility”) and observe the game or event identified on the ticket (“Event”). By using the ticket, Holder for him/herself and for any accompanying minor(s), agrees to the terms and conditions below and at https://www.mlb.com/pirates/tickets/ticket-back-terms-conditions, any applicable Major League Baseball rules and the standards of guest conduct published on the Pirates’ website (www.pirates.com/a-z), which are incorporated by reference (“Agreement”). This license may be terminated without compensation if Holder violates the Agreement, or for any reason in the Pirates’ sole discretion, by refunding the price on the face of the ticket to the original purchaser. The Pirates reserve the right to change the terms and conditions of the Agreement at any time, by posting changes on the team website identified above. Holder is solely responsible for reading and understanding the Agreement before using this ticket and/or those of minor(s).
This license may be terminated without compensation if the ticket is resold in violation of this Agreement or applicable law. The ticket cannot be replaced if lost, stolen or destroyed. Tickets obtained from sources other than the Pirates or Tickets.com could be lost or stolen. Holders of lost or stolen tickets will not be admitted to the Event. Holder consents to manual or electronic inspection of their person and personal property at any time inside the Facility. Holder may be denied entry or ejected from the Event if Holder is found to be in possession of any potentially dangerous, hazardous, inappropriate or injurious objects. Such objects may also be confiscated. Holder may not bring any glass bottles, cans or alcoholic beverages inside the Facility. Trespassing, disrupting the Event or attempting physical contact with a participant will be prosecuted to the fullest extent of the law.
ASSUMPTION OF RISK AND RELEASE: Holder and accompanying minor(s) assume all risk and danger incidental to the Event, occurring in any part of the Facility, including but not limited to the stands, concourses and concession areas, at any time prior to, during or subsequent to the Event (including but not limited to, injuries from balls, bats or other objects entering the stands, including objects projected into the stands for entertainment purposes). Holder agrees to waive and release any claim that the Pirates, PNC Park, the Sports and Exhibition Authority, Major League Baseball, the Participating Clubs, and all of their respective parents, subsidiaries, affiliated entities, players, coaches, officers, members, managers, employees, partners, sponsors, and agents are liable or responsible for losses or injuries to person or property arising or related in any way to Holder’s or any accompanying minor(s)’ use of this ticket. Please stay alert and be aware of your surroundings.
Holder will not transmit or aid in transmitting any description, account, picture, video or audio of the Event (including pre- and post-Event activities). The Pirates are the exclusive owner of all intellectual property associated with the Event. Holder and accompanying minor(s) grant the Pirates or their designees an unrestricted, worldwide license in perpetuity to use Holder’s name, voice, image, likeness, actions, comments and/or other publicity rights taken in any media before, during or after the Event for any purpose without notification or compensation.
ARBITRATION AGREEMENT / CLASS ACTION AND JURY TRIAL WAIVER: All disputes related to this Agreement, the purchase or use of this ticket, or participation in, attendance at, or observation of an Event (“Arbitration Claims”) must be submitted for and resolved by binding arbitration. Additional information can be found on the Pirates’ website (www.pirates.com/a-z). Holder acknowledges certain rights he/she would have in court, including to a jury trial and appeal, are not available in arbitration. Holder agrees that Arbitration Claims must be arbitrated on an individual basis, and not joined with claims of other parties or pursued in a class or other form of representative action. Arbitrations shall be administered by JAMS pursuant to their applicable rules. Holder waives any right to resolve Arbitration Claims in a jury trial or class action.
COVID-19 is an extremely contagious disease that can lead to severe illness and death. An inherent risk of exposure to COVID-19 exists in any public place regardless of precautions that may be taken. Holder, on their behalf and on behalf of any minor(s) and Accompanying Parties (as defined below), agrees to (i) assume all risks associated with COVID-19 and other Communicable Diseases, and (ii) comply with all related health & safety policies of the Pirates and the Facility owner/operator.

Information is also available by calling 1-800-BUY-BUCS or by visiting the PNC Park Ticket Office. Please retain this ticket stub as it will need to be presented at the time of exchange.

COVID-19 and Other Infectious and/or Communicable Diseases, Viruses, Bacteria or Illnesses: Holder, on their behalf and on behalf of accompanying minor(s) and any other accompanying party for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (“Accompanying Parties”), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Pirates and/or the Facility owner/operator, including, without limitation, any policies and protocols regarding security, bags, fan conduct and health and safety, currently available at https://www.mlb.com/pirates/ballpark/information, all of which, due to the evolving nature of the COVID-19 pandemic, may continue to be updated from time to time between purchase of this ticket and the Event date, and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable laws and policies of federal, state, city and local authorities.
FAN HEALTH PROMISE
Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder, accompanying minor(s) and/or Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder, accompanying minor(s) nor Accompanying Parties will attend the Event if within fourteen (14) days preceding the Event, they have:
(i) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR
(ii) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR
(iii) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.
A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.
RESALE TERMS AND POD INTEGRITY
Holder, on their behalf and on behalf of accompanying minor(s) and Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase not specifically enumerated herein, including without limitation (1) terms that mandate or prescribe the quantity of tickets available to be purchased, (2) additional requirements regarding Accompanying Parties, and (3) terms regarding the resale or transfer of tickets.
ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES
Holder, on their behalf and on behalf of accompanying minor(s) and Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Facility. By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder, accompanying minor(s) and Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder, accompanying minor(s) or Accompanying Parties will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.
HOLDER, ON BEHALF OF HOLDER, ACCOMPANYING MINOR(S), ACCOMPANYING PARTIES, AND THEIR RESPECTIVE PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES (AS DEFINED BELOW) WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE FACILITY OR © PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE FACILITY, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, MINOR(S), ACCOMPANYING PARTIES OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, MINOR(S) OR ACCOMPANYING PARTIES; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER, MINOR(S) OR ACCOMPANYING PARTIES. The “Released Parties” shall include (a) the Pirates and the other Major League Baseball Clubs (“Clubs”), Pittsburgh Associates of Florida, LLC, LECOM Concessions, LLC, MLB Advanced Media, L.P., the Office of the Commissioner of Baseball (“BOC”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities (the “MLB Parties”); (b) the owners and operators of the Facility, and event sponsors, contractors, vendors, operators, agencies and advertisers of the MLB Parties and Facility; © licensees, and retail, concession, broadcast and media partners of the MLB Parties; (d) press and other media; (e) vendors that may provide testing or medical services; (f) entities and individuals providing accommodation and transportation to or from the Facility; (g) other entities and individuals who enter the Facility; and (h) the respective parent, subsidiary, affiliated and related companies and officers, directors, employees, agents, licensees, contractors, sub-contractors, insurers, representatives, successors, assigns of each of the foregoing entities and persons.
[FOR CALIFORNIA RESIDENTS] YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOU ARE FAMILIAR WITH AND DO HEREBY WAIVE THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE (AND SIMILAR PROVISIONS OF OTHER JURISDICTIONS) WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable.
